it was my understanding that it was a re-trial because the judge gave incomplete or incorrect instructions to the jury the first time around.

I hate to say it, but you are correct.

I believe the issue, during instructions, was concerning the definition of the word "distributing".

The first trial was a travesty, the second a joke ... on the taxpayers.

This article is no surprise to me. There are a number of artists that I heard someone recommend, then downloaded some of their songs, decided whether I liked the music or not and then bought the album. Stefano Barone, Chris Botti, Michael Buble, Dreamtheater, and more... Without having downloaded their music first I would have likely never purchased it.

Some artists you can listen to online from their websites, which sometimes is enough, but often the quality is much worse than even MP3. So it is tough to tell whether it is a well recorded work or not, which is important to my buying decision.

I understand the record industry's problem, but if they want my sympathies they are going to have to come up with a better way to reach me as a customer. As an audio and music enthusiast, part of "reaching me" is also delivering well recorded high resolution works. Sadly, I fear the industry is moving the other direction.
